PUBLIC HEARING
PLEASE TAKE NOTICE THAT the Board of Zoning Appeals of the Incorporated Village of Sands Point will enter into Executive Session on Monday, January 13, 2025, at 6:00 p.m. At 7:00 p.m. the Board of Zoning Appeals will hold a public hearing at Village Hall, 26 Tibbits Lane Sands Point, NY 11050 on the following applications:
New Cases:
1) Application of Michael Herman for a Variance pursuant to Chapter 176 of the Code of the Village of Sands Point, specifically: (i) Section 176-32(A) to construct a pool house and patio in the rear yard to permit a rear yard lot coverage of 26.6%, where 15% is the maximum permitted; and (ii) Section 176-32(D) to construct a pool patio that is setback 73.58 feet from the street line on Messenger Lane, where the minimum required setback for accessory buildings is 80 feet from every street line on property owned by them in a Residence B District and located at 20 Soundview Lane, Sands Point, New York 11050, also known as Section 4, Block 112, Lot 1 on the Nassau County Land and Tax Map.
2) Application of Seth & Talia Grossman for a Variance pursuant to Chapter 176 of the Code of the Village of Sands Point, specifically: (i) Section 176-13(A)(1) to violate the required front yard sky plane by 8 feet; (ii) Section 176-18(A) to maintain a shed in the side yard, where accessory buildings or structures are only permitted in the rear yard; (iii) Section 176-18(C) to maintain a shed 2.4 feet from the side yard lot line and 18.1 feet from the main dwelling, where a side yard setback of 20 feet is the minimum required and where 25 feet is the minimum required distance between an accessory structure and the main building on property owned by them in a Residence A District and located at 40 South Road, Sands Point, New York 11050, also known as Section 5, Block 23, Lot 48 on the Nassau County Land and Tax Map.
3) Application of 5 Cedar Knoll, LLC/Eric Blumencranz for Site Plan Review Approval pursuant to Section 132-4(A)(1) of the Code of the Village of Sands Point to construct a new two-story single-family dwelling with attached garage, pool, generator, A/C, fence, patio and drywells on property owned by them in a Residence A District and located at 7 Cedar Knoll Drive, Sands Point, New York 11050, also known as Section 4, Block A, Lot 439 on the Nassau County Land and Tax Map.
4) Application of 5 Cedar Knoll, LLC/Eric Blumencranz for a Fill Permit pursuant to Chapter 84 of the Code of the Village of Sands Point to remove 6,150 cubic yards of fill and move 2,800 cubic yards of fill around the property owned by them in a Residence A District and located at 7 Cedar Knoll Drive, Sands Point, New York 11050, also known as Section 4, Block A, Lot 439 on the Nassau County Land and Tax Map.
Continued Cases:
1) Application of Gabriel & Gabriella Benji for Site Plan Review Approval pursuant to Section 132-4(A)(1) of the Code of the Village of Sands Point to construct a new two -story single-family dwelling with an attached three car garage on property owned by them in a Residence A District and located at 21 Hicks Lane, Sands Point, New York 11050, also known as Section 4, Block C, Lot 37 on the Nassau County Land and Tax Map.
2) Application of Gabriel & Gabriella Benji for a Fill Permit pursuant to Chapter 84 of the Code of the Village of Sands Point to place 2,150 cubic yards of fill around the property owned by them in a Residence A District and located at 21 Hicks Lane, Sands Point, New York 11050, also known as Section 4, Block C, Lot 37 on the Nassau County Land and Tax Map.
3) Application of Gabriel & Gabriella Benji for Variances of Chapter 176 of the Code of the Village of Sands Point, specifically: (i) Section 176-11(A) to exceed the maximum allowable habitable floor area by 975 square feet; (ii) Section 176-11(B) to exceed the maximum allowable lot coverage by 4.2%, where 20% is the maximum permitted; (iii) Section 167-13(A)(2) to violate the south side yard sky plane by 11’6’’ and to violate the north side yard sky plane by 17’1’’; (iv) Section 176-18(A) to exceed the maximum allowable rear yard lot coverage by 21.1%, where 15% is the maximum permitted; (v) Section 176-18(A) to construct an in-ground pool with a terrace in the front yard; (vi) Section 176-18(B) to construct an in-ground pool with a pool house and patio nearer to the street line than the rear line of the main dwelling; (vii) Section 176-19(A) to construct a driveway that is 16 feet wide at the street line, where 15 feet is the maximum allowable; (viii) Section 176-19(A) to construct a driveway that is as close as 6 feet 6 inches and twenty feet from the side property line, where a minimum of 25 feet is required on property owned by them in a Residence A District and located at 21 Hicks Lane, Sands Point, New York 11050, also known as Section 4, Block C, Lot 37 on the Nassau County Land and Tax Map.
