BOARD OF ZONING APPEALS

PLEASE TAKE NOTICE THAT the Board of Appeals of the Incorporated Village of Sands Point will convene to hold a public hearing on Tuesday, October 15, 2024, at 7:00 p.m. in the evening at Village Hall, 26 Tibbits Lane, Sands Point, NY 11050 on the following applications: 


Continued Case(s):

 

1)    Application of Shepherd Developers LLC for Site Plan Review Approval pursuant to Chapter 132-4(A)(1) of the Code of the Village of Sands Point to construct a new two-story wood frame single-family dwelling with an attached 4 car garage, sports court, and in-ground swimming pool with a pool terrace on property owned by them in a Residence A District and located at 4 Shepherds Lane, Sands Point, New York 11050, also known as Section 4, Block B, Lot 325 on the Nassau County Land and Tax Map.

 

2)     Application of Shepherd Developers LLC for a Fill Permit pursuant to Chapter 84 of the Code of the Village of Sands Point to remove 3,900 cubic yards and to move 1,400 cubic yards of fill around the property owned by them in a Residence A District and located at 4 Shepherds Lane, Sands Point, New York 11050, also known as Section 4, Block B, Lot 325 on the Nassau County Land and Tax Map.

 

3)     Application of Shepherd Developers LLC for a Variances of Chapter 176 of the Code of the Village of Sands Point, specifically: (i) Section 176-14.1 to permit the proposed dwelling to be constructed in a position that results in the shorter side of the house parallel to the street with the longest street frontage; (ii) Section 176-18(A) to permit the construction of a sports court and in-ground pool with a pool terrace in the front yard, as well as maintain an existing shed in the front yard, where all accessory structures must be located only in the rear yard; (iii) Section 176-18(B) to permit the proposed sports court and in-ground pool with pool terrace on a corner lot abutting the street, where no accessory structures are permitted in any yard abutting any street; (iv) Section 176-19(E) to permit the proposed sports court in the front yard, where sports courts are only permitted in the rear yard of a dwelling; (v) Section 176-19(F)(1) to permit the construction of a sports court with no fence, where a fence of a design approved by the Board of Appeals and the Building Inspector enclosing the sports court is required; and (vi) Section 176-19(G) to permit the proposed sports court to have screening on only two sides, where complete screening on all sides is required, on property owned by it in a Residence A District and located at 4 Shepherds Lane, Sands Point, New York 11050, also known as Section 4, Block B, Lot 325 on the Nassau County Land and Tax Map.

 

4)     Application of Shepherd Developers LLC for a Sports Court Permit pursuant to Chapter 176-76 of the Code of the Village of Sands Point to install a tennis court on the property owned by it in a Residence A District and located at 4 Shepherds Lane, Sands Point, New York 11050, also known as Section 4, Block B, Lot 325 on the Nassau County Land and Tax Map.

 

5)     Application of Aaron & Laila Shirian for Site Plan Review Approval pursuant to Chapter 132-4(A)(1) of the Code of the Village of Sands Point to construct a new single-family residence with an in-ground swimming pool, pool terrace, and wood deck on property owned by them in a Residence B District and located at 1 Cedar Lane, Sands Point, New York 11050, also known as Section 4, Block F, Lot 127 on the Nassau County Land and Tax Map.

 

6)     Application of Aaron & Laila Shirian for a Fill Permit pursuant to Chapter 84 of the Code of the Village of Sands Point to move 2,850 cubic yards around and place 2,150 cubic yards of fill at the property owned by them in a Residence B District and located at 1 Cedar Lane, Sands Point, New York 11050, also known as Section 4, Block F, Lot 127 on the Nassau County Land and Tax Map.

 

The application(s), plan(s), and specification(s) are on file at the Office of the Village Clerk, 26 Tibbits Lane, Sands Point.  At said time and place of Hearing as aforesaid stated all persons who wish to be heard will be heard.
